§1 General

All deliveries and services are made exclusively on the basis of the following terms and conditions (GTC) in their version valid at the time of the order. Deviating conditions of the customer are not recognized if Fasttuning has not previously agreed in writing.

All information in the database without guarantee. Deviations of 10-15% are normal depending on the age of the vehicle.

§ 2 Conclusion of Contract

The customer’s order constitutes an offer to Fasttuning to conclude a purchase contract. When the customer places an order with Fasttuning, Fasttuning immediately sends the customer an order confirmation by e-mail. This does not constitute an acceptance of the offer.

A contract of sale is not concluded until Fasttuning ships the ordered goods to the customer. Credit notes are valid for 4 weeks!

§ 3 Widerrufsbelehrung

If the customer is a consumer, he can revoke his contract declaration within 14 days without giving reasons in writing (eg letter, mail, fax) or by returning the goods.

The period begins at the earliest one day after receipt of a separate notice of revocation in writing, but not before the day of receipt of the goods by the customer. To comply with the revocation period, it is sufficient to send the revocation or the goods in time.

The right of withdrawal does not exist in the exceptional cases regulated by law, in particular

– for contracts for the supply of goods that are made to customer specifications or

– for goods that are clearly tailored to the personal needs of the customer or

– for goods that are not suitable for return due to their nature.

-Motorsport items without approval

In the event of an effective revocation, the mutually received benefits are to be returned and any benefits derived (eg interest). If the customer cannot return the goods in whole or in part or only in a deteriorated condition, Fasttuning can demand compensation for the value. This does not apply if the deterioration is exclusively due to the inspection as in a retail store or the intended use without further use of the goods. In all other respects, the customer can avoid the obligation to pay compensation by not using the goods as if they were his property and by refraining from doing anything that would impair their value.

Goods that can be sent by parcel are to be returned by the customer at the expense and risk of Fasttuning.

In deviation from this, the customer must bear the costs of the return shipment if the delivered goods correspond to the ordered goods and if the price of the goods to be returned does not exceed an amount of EUR 40.00 or if, in the case of a higher price of the goods, the customer has not yet provided the consideration or a contractually agreed partial payment at the time of the revocation. Otherwise, the return shipment is free of charge for the customer. Items that cannot be shipped by parcel will be collected from the customer.

§ 4 Delivery

Unless otherwise agreed, the delivery will be made from the warehouse of Fasttuning to the delivery address specified by the customer. Information about the delivery time is not binding, unless exceptionally the delivery date was bindingly promised.

If Fasttuning is not able to deliver the ordered goods through no fault of its own, because the supplier of Fasttuning does not fulfill its contractual obligations, Fasttuning is entitled to withdraw from the contract with the customer. In this case, the customer will be informed immediately that the ordered product is not available. The legal claims of the customer remain unaffected.

If a delivery to the customer is not possible because the delivered product does not fit through the entrance door, front door or staircase of the customer or because the customer is not met at the delivery address provided by him, although the delivery date was announced to the customer with reasonable notice, the customer bears the costs for the unsuccessful delivery.

§ 5 Prices

The stated prices are final prices and include the statutory sales tax. In addition, costs for packaging and shipping are to be borne by the customer.

§ 6 Payment, due date and default

The customer can pay the purchase price plus applicable shipping costs by prepayment or cash on delivery.

The prepayment is to be made within 7 days after receipt of the order confirmation. Decisive is the time of receipt of money at Fasttuning.

§ 7 Retention of Title

The ordered goods remain the property of Fasttuning until full payment. Before transfer of ownership, a pledge, transfer by way of security, processing or transformation without the express consent of Fasttuning is not permitted.

§ 8 StVZO

The customer undertakes after the software optimization to register his car / truck in accordance with the StVZO. The same applies to Active Sound Systems.

Appraisals are not offered by Fasttuning

§ 9 Applicable Law – Jurisdiction

This contract is subject to German law.

If the buyer is a merchant, the parties agree on the jurisdiction of Munich.

§ 10 Warranty

Fasttuning expressly gives warranty only on installed parts.No liability for engine or consequential damages.An engine warranty can be concluded optionally because the factory warranty may expire.

Attention: Software changes of any kind and already installed tuning parts,Motorsport articles +Soundbooster are excluded from the exchange.
